This Agreement defines the conditions of use of the materials and services of the website https://otome.com.ua (hereinafter referred to as the Website, website, online store) by the Customers (Buyers). 1.2. This Agreement in accordance with Art. 633, 641 and Chapter 63 of the Civic Code of Ukraine is a public contract (offer) and is addressed to an unspecified number of persons, regardless of their status (natural person, legal entity, natural person - entrepreneur), wishing to purchase products in the online store https://otome.com.ua.. . 1.3. Since the present Agreement is a public offer, by accessing the materials on the Website the Customer (Buyer) is deemed to adhere to the present Agreement.. 1.3. 1.4 The administration of the Site (the owner of the site https://otome.com.ua and/or persons authorized by him) has the right to unilaterally change the terms of this Agreement at any time. The new or amended Agreement shall enter into force at the moment of its publication on the Website. If the Customer is not satisfied with the changes made, he/she is obliged to refuse access to the Website, stop using the materials and services of the Website.. 1.5. The Buyer accepts this public offer in full and without qualification by placing the Order on the Site.. 1.6. Visitor (Buyer) agrees that he/she understands all terms and conditions of the Terms of Use and accepts them fully and unconditionally.
2.1. In order to form orders on the Site, the Customer (Buyer) can go through the registration procedure and enter the required data in accordance with the questionnaire.. 2.2. When registering on the Site, the Customer (Buyer) is obliged to provide true and accurate information about himself and his contact details, in order that the Site Administration can fulfill its obligations to the Customer (Buyer) and deliver the paid Goods to him.. 2.3. In the process of registration on the Site, the Customer (Buyer) shall provide a user name (his e-mail address) and a password, for the security of which he is responsible. The Customer (Buyer) is obliged not to disclose to third parties the login and password specified during registration, and to store these data in a place inaccessible to third parties. The Merchant is solely responsible for all actions performed on his behalf, i.e. using his login and password.
3.1 The information provided by the Customer (Buyer) is confidential. The site administration uses the information about the Customer (Buyer) in order to fulfill the requests of the Visitor (Buyer), unless other purposes are specified in this Agreement.. 3.2. Cookies do not contain personal information and cannot in any way read information on the Visitor's (Buyer's) hard disk. Cookies are used to improve the quality of the services provided, including.for quick identification of the User (Buyer); preservation of the User's (Buyer's) preferences, his/her personal advantages, tracking of the User's (Buyer's) access session status and trends. The Administration also uses cookies for advertising purposes, including the management of advertisements on Internet sites. In case of deactivation of the cookie technology by the Visitor (Buyer), the Administration does not guarantee the full functionality of the website https://otome.com.ua or some of its services.. 3.5. The Purchaser authorizes the Administration to process his/her personal data, including the following: placing personal data in the Administration's database (without additional notification in this regard), carrying out additional storage of data, their accumulation, updating, modification (to the extent necessary). The Administration is obliged to protect the data from unauthorized access by third parties, not to disclose them and not to transfer them to third parties (except data transfer to related persons, business partners, persons authorized by the Administration to carry out impartial data processing for the specified purposes, as well as at the mandatory request of the competent state authority). 3.6. If the Visitor (Buyer) does not wish to receive a newsletter about promotions, new products, etc., he/she has the right to refuse it by sending a letter to the Administration and/or leaving a record of it in his/her private office.. 3.7. 3.7. The Administration is not responsible for the content and accuracy of the information provided by the Visitor (Buyer) when registering on the website https://otome.com.ua and making the Request. The Submitter (Buyer) is responsible for the accuracy of the information provided when registering on the website and drafting the Substitution is subject to all risks associated with the lack of accuracy of such information.
4.1. All registered Customers (Buyers) participate in the Otome Discount Program.. . 4.1.1 The program is intended solely for the personal use of natural persons. The Otome Discount Program may not be transferred, sold, offset or otherwise disposed of.. 4.2. In accordance with the terms and conditions of the Program, the Bali Bonus is accrued for each order in the online store otome.com.ua (except for products in the "Health" section).. 4.3. 4.3. The Bali Bonus is accrued in the personal bonus account of the Customer (Buyer) and is available for review in the Personal Cabinet 4.4. The Organizer has the right to suspend the Program, cancel it or change its conditions at any time. If the Program is closed, all Bali Bonuses earned by the Participant may be used within 30 (thirty) calendar days from the date of publication of the relevant announcement on the website about the closure of the Program.. 4.4.1 The Organizer has the right to debit the account of the Customer (Buyer) from the Program the Bali Bonus charged by mistake, related to the purchase, which was downloaded, in case of return of the goods, as well as in case of detection of fraud and/or unfair practices.. 4.5. 4.5. If the goods are purchased using credit (payment in installments), the Bali Bonus is charged in the same amount as in the case of making a purchase for payment by credit card and/or payment by bank card.. 4.6. Special bonuses may be calculated by the Organizer during promotional campaigns, special promotions and Program offers. Special bonuses have a limited period of validity, which corresponds to the conditions of the promotion. After the expiration of the action these bonuses are cancelled from the Participant's account and cannot be used by him.. 4.7. In case of return of the previously purchased products, the bonuses accrued for the purchase are cancelled. In case of exchange of the product, the bonuses accrued for the returned product are cancelled and the bonuses for the purchased product are accrued. Return and exchange of products purchased by the Participant is carried out within the framework of the rules established by the Law of Ukraine "On Protection of Consumer Rights".. 4.8. Accumulation of bonus points for the purchase made on the website otome.com.ua is carried out after receipt of payment for the purchase made.. 4.9. The Organizer reserves the right to change the conditions (schemes) of accumulation of bonuses. 4.9. 4.10. The bonuses are credited to the account of the Client (Buyer) provided that the online store has all the technical and/or other capabilities necessary for this purpose: Internet connection, electricity and properly functioning software. If the technical and/or other capabilities necessary for crediting the bonuses are not available, the bonuses will be credited to the Customer's (Buyer's) account once the necessary capabilities are restored.. 4.11. The Customer (Buyer) has the right to use the Bonuses, which are on his account, as a discount when purchasing any goods in the online store otome.com.ua (except for restrictions on the purchase of goods, established by the Organizer).. 4.12. Bonuses are used (debited) from the Participant's account at the following exchange rate:. - 1 bonus = 1 hryvnia discount on the purchase of goods. Bonuses cannot be used (deducted) on the purchase of goods on credit or by "Payment in installments".. 4.13. The Organizer reserves the right to change the list of goods/services that the Participant can use the Bonuses when purchasing.. 4.14. The Program Organizer reserves the right to modify the list of goods/services that the Participant can use the Bonuses when purchasing. 4.14. The Program Organizer determines the goods for which the Participant can use Bonuses.. 4.15. Bonuses may be used as a reduction of the price of the goods (with the exception of goods in the "Health" section), but not more than 50% of the amount of the check.. 4.16. Bonuses may not be converted into a cash equivalent and given to the Participant in cash.. . 4.17. The Program Organizer is not responsible for the payment of taxes and fulfillment of the Participant's obligations related to his participation in the Program.. 4.18. This Discount Loyalty Program is a long-term program.. 4.19. The Organizer has the right to unilaterally modify these Terms and Conditions.. 4.20. A 10% discount on the entire range of products in the online store otome.com.ua (with the exception of products from the "Health" section) is available to customers with a name day: 3 days before the day of birth and 3 days after. The discount is not combined with other promotions, which are currently running in the store.
